Chapter 3 - Insert 3

My heart was beating so fast,

he just looked at me while his phone was still

on his ear. His face looked so annoyed.

Mr Ndlovu: "Excuse me, who are you?"

Lino : "Am Lino Zikelele."

Mr Ndlovu: "What do you want?"

Lino : That question caught me off

guard. I didn't expect it so soon.

"Uummhhh."

Mr Ndlovu: " I'm busy,i don't have time to

listen to your stupid murmuring."

Then he walked away and started talking on his

phone again. "Sorry, baf, some girl was here

disturbing me kodwa we can continue now."

Lino : I watched him walking away.

Well, I didn't see him walking away; I

actually saw my dream walking away.

Then I remembered my late father's words in

my head again. Then Jeremiah 29:11 came into my

heart: "For I know the plans I have for you,

plans to prosper you and not to harm you…."

I felt my confidence building up, and I ran to

him again. This time he was facing mydirection and looking at me running

toward him.

Mr Ndlovu: "But what's wrong girl,

where's the security ." He looked more

annoyed now.

Lino : "I want to share my thoughts

about the case with you." I maintained

eye contact with him.

Mr Ndlovu: "I don't have time for

journalists, I'm busy sisi."

Lino : "I am not a journalist, I am an

admitted attorney of the High Court of

South Africa and I didn't say I want to

hear your thoughts I'm saying, I want to share

with you about my thoughts."

ok Lino , did you just say that to him,

but I didn't show him, I was scared and

intimidated. I maintained this confidence

look. He just looked at me puzzled, like

he didn't know what to say. I could see

he was in some deep thoughts.

Lino mtha: I knew I had to strike

immediately while he's still busy looking

at me that way. "The prosecutor used the

medical report, but there was no medical

officer to come and testify regarding

that report. That is hearsay evidence. In

our law, hearsay evidence, whether oral

or in writing, the probative value of which

depends upon the credibility of any

person other than the person saying it.

The general rule is that hearsay officer must hear all relevant evidence

offered. He or she normally does not

have the right to ignore or refuse to hear

any evidence related to the case.

However, there is one exception to this

rule, that being that the evidence

admitted must also be legally

permissible. Our law is explicit in that

hearsay evidence is not allowed."

Lino mtha: he was still looking at me, but

the look was so inquisitive now. He was

listening attentively and I knew that I

had gained his attention. I continued

with so much confidence: "Section 3 of

the Evidence Act makes the following

provision: Subject to the provisions of

any other law, hearsay shall not be
