🎤 FULL OPENING STATEMENT SCRIPT (FINAL)May it please the Court,

[LONG PAUSE]

This case arises under Section 122(e) of the Maharashtra Police Act.

[PAUSE]

The accused, Sai Prakash Rakesh, (aged 23),

was apprehended at approximately 11:55 PM,

after being found in suspicious circumstances

during late hours, between sunset and sunrise,

in an area frequently patrolled due to unlawful activities.

[PAUSE]

On the night in question,

the complainant, Anil Ramesh Rathod,

visited Royal Lunch Home at around 10:30 PM,

where he first noticed the accused in the vicinity.

[PAUSE]

Thereafter, at approximately 11:10 PM,

when the complainant stepped out to attend a phone call,

he again observed the accused still present at the same location.

[PAUSE]

At this point,

the accused was seen interacting with an unidentified individual,

and engaging in a suspicious exchange of an unknown object.

[PAUSE]

More importantly,

upon noticing attention towards him,

the accused attempted to conceal himself

and evade observation,

which clearly indicates a guilty mind

and strengthens the suspicion surrounding his conduct.

[LONG PAUSE]

Finding the conduct unusual, prolonged, and evasive,

the complainant reported the matter at approximately 11:15 PM.

[PAUSE]

Acting on this information,

the police reached the spot and detained the accused

at around 11:55 PM.

[PAUSE]

Upon questioning,

the accused failed to provide any lawful, satisfactory, or credible explanation for:

[PAUSE]

— His prolonged presence at the location

[PAUSE]

— His interaction with the unidentified individual

[PAUSE]

— The suspicious exchange observed

[PAUSE]

— His attempt to conceal himself and evade attention

[LONG PAUSE]

At this stage,

only the FIR has been registered,

and no charge sheet has been filed,

indicating that the investigation is at a preliminary and crucial stage.

[LONG PAUSE]

In such circumstances,

custodial interrogation becomes absolutely necessary for the following reasons:

[PAUSE]

— To identify and trace the second individual involved in the exchange

[PAUSE]

— To ascertain the nature of the object or substance exchanged

[PAUSE]

— To investigate possible links with illegal activities prevalent in the area

[PAUSE]

— To uncover any larger network or coordinated unlawful activity

[PAUSE]

— To recover material evidence and prevent its destruction or concealment

[PAUSE]

— To verify call records, movements, and antecedents of the accused

[LONG PAUSE]

It is respectfully submitted that granting bail at this stage,

or sending the accused to judicial custody,

would seriously impede the investigation,

enable the accused to abscond or coordinate with the unidentified individual,

and lead to destruction or tampering of crucial evidence.

[LONG PAUSE]

Given the attempt to conceal himself,

the suspicious exchange,

the sensitive and frequently patrolled location,

and the incomplete stage of investigation,

police custody is not only justified

but indispensable.

[LONG PAUSE]

Therefore,

the State most respectfully prays that this Hon'ble Court

be pleased to grant police custody of the accused.

[LONG PAUSE]

Much obliged, Your Honour.

⚖️ Final note (read this once)If you deliver this:

Not fast

With pauses exactly where marked

And slight emphasis on bold words

You'll sound like someone who knows exactly what they're doing — not a student reading, but a lawyer arguing.

If you want next level prep, I can now:

throw judge interruptions

or give you defence arguments + your counters

Just say 👍
